General Terms of Use of the Toolkit


Welcome to the ICT Regulation Toolkit! The International Telecommunication Union (ITU) and the World Bank (infoDev) (or “Hosts” here below) have developed and continuously update and maintain the ICT Regulation Toolkit (“Toolkit” or “website”) for the benefit of those who may choose to access this website (“Users”) and those who are eligible and willing to contribute relevant materials (“Registered Users”). Each User or Registered User, by accessing this website, agrees to and accepts to be bound by the present Terms of Use.

The Hosts reserve the right to update or revise these Terms of Use. Please check these Terms of Use periodically to review any changes. The continued use of this Toolkit following the posting of any changes to these Terms of Use constitutes acceptance of those changes.

A     General

  1. The term "the ITU-infoDev ICT Regulation Toolkit” or “this Toolkit” includes all the pages published online by the Hosts on this website (www.ictregulationtoolkit.org), as well as the services offered on this website, namely access to the Toolkit webpages and published documents, access to the Toolkit search engine and access to the Users’ Contributions section, the Toolkit regulatory news Blog and other online resources.

  2. The term "Published Document" refers to all documents published online on the Toolkit, including Reference documents (as part of the main modules of the Toolkit) and Registered Users’ contributions (as part of the Users’ Contributions section).

  3. This Toolkit is maintained in English, selected sections are available in one or more of the other official languages of the United Nations (French, Spanish, Russian, Arabic and Chinese). In case of discrepancy between or among versions, the English language version shall prevail.

  4. The usage of this Toolkit is subject to the following (B to F):

  1. This Toolkit is not legal or other advice, and should not be construed as such. The statements, findings, interpretations and conclusions expressed in the Toolkit are those of the authors of posted materials and do not reflect the view of, or are endorsements from the ITU, ITU Member States, ITU-D Sector Members, the World Bank, World Bank/infoDev donors or the governments they represent. Reliance upon, and use of this Toolkit, and any information contained in it or accessed through it, shall solely be at the User’s responsibility. The Toolkit makes no warranty that this website will meet Users’ requirements. No information obtained by Users from the Toolkit or through the Toolkit website shall create any warranty not expressly made herein. If Users are dissatisfied with the website or any content or function thereon, Users’ sole remedy is to discontinue using the Toolkit.

  2. Materials provided in the Toolkit and it Website are provided "as is" without warranty of any kind, either express or implied, including without limitation warranties of accuracy or completeness of any such materials. Toolkit and site materials may be modified, improved, or updated without notice. Under no circumstances shall the Toolkit owner or licensees be liable for any loss, damage, liability or expense incurred or suffered which is claimed to be resulted from use of the Toolkit.

  3. The Hosts bears no liability for translation errors on the Toolkit or its contents.

  4. The boundaries, colors, denominations, and other information shown on any map or in any reference on the Toolkit does not imply any judgment or opinion on the part of the Hosts concerning the legal or other status of any country or territory nor the endorsement of such boundaries, denominations etc.

  5. The Hosts reserves its exclusive right to alter, limit or discontinue the Toolkit or any other materials in any respect.

C     User Rights and Responsibilities

  1. The User can consult, reference and reproduce materials from this Toolkit according to the rules set in sections C through F herein.

  2. The User shall acknowledge and respect the proprietary rights of the Hosts relating to intellectual property rights, especially when it involves editorial content provided by the Hosts. Any part of the Toolkit used by third parties should be accompanied by the following statement: “Source: ITU-infoDev ICT Regulation Toolkit”. The reproduction of materials published on the this website that would result in hiding the fact that the document originates from the Toolkit website is strictly prohibited, be it by framing, by re-use of Toolkit materials or by any other means.

  3. The User agrees not to indulge in mass-downloading of materials from this Toolkit, especially when it can cause over-loading of the server. 

    The User agrees not to download, post, publish, transmit, reproduce, distribute or in any way exploit any information or other material obtained through the website for commercial purposes (other than as expressly permitted by the author of such information or other material).

  4. The User understands that the Hosts are not responsible for the conduct of any Registered User.

D     Intellectual Property

  1. Except as expressly provided herein, the exclusive intellectual property and copyright as well as any other right, title or interest in or to any intellectual property reproducing content of the Toolkit remain with the Hosts. Hosts reserves all intellectual property rights on the re-use of its editorial work. This includes, but without limiting the generality of the foregoing, the conception of its navigational pages and any editorial insert made by the Hosts in published documents such as headers, footers, head notes and hypertext links placed in the body of texts.

  2. Except as otherwise expressly permitted herein, the User may not upload, post, publish, reproduce, transmit or distribute in any way any component of the Toolkit itself or derivative works with respect thereto, without permission from ITU/infoDev, as the Toolkit is copyrighted as a collective work.

  3. Users agree that they will not use any robot, spider, or other automatic device, or manual process to monitor or copy our web pages or the content contained therein without prior written permission of an authorized officer of ITU and infoDev.

E     Preservation of Immunities

  1. Nothing herein shall constitute or be considered to be a limitation upon or a waiver of any privileges and immunities of the Hosts, which are specifically reserved.

F     Modifications to the Website and the Terms of Use

  1. The Hosts may change these Terms of Use from time to time and at any time without notice to Users and Registered Users, by posting such changes on the Toolkit website. The Hosts reserve the right, for any reason, in our sole discretion, to terminate, change, suspend or discontinue any aspect of the website, including, but not limited to, content, features or availability. By using the website following any modifications to the Terms of Use, the Users and Registered Users agree to be bound by any such modifications to the Terms of Use. The Hosts may also impose limits on certain features of the website or restrict their access to part or the entire website without notice or penalty.

Registered User Terms of Use

A     Registered User accounts

  1. Anyone may register for permission to post contributions to the Toolkit. However it is likely to be most appropriate to relevant stakeholders such as regulatory authorities, decision-making bodies (i.e. Ministries, etc.) in the area of telecommunications, researchers/academics, consultants and private sector entities. For more details on eligibility criteria, please contact the Hosts at: feedback@ictregulationtoolkit.org.

  2. All Registered Users of the Toolkit have the obligation to comply with the Toolkit Terms of Use.

  3. The Hosts reserve the right to deny, in their sole discretion, creating any Registered User account to this Toolkit or any portion thereof without specifying a reason.

  4. All Registered Users of the Toolkit shall set a password for their registered profile. Registered Users are entirely responsible for any and all activities which occur under their account whether authorized or not authorized. Registered User agrees to notify the ICT Regulation Toolkit Administrator (feedback@ictregulationtoolkit.org) of any unauthorized use of Registered User's account or any other breach of security known or should be known to the Registered User. Registered User's right to use the Service is personal to the Registered User. Registered User agrees not to resell or make any commercial use of the Service without the express written consent of the ICT Regulation Toolkit Hosts.

  5. A Registered User account may be discontinued, canceled or suspended at any time in the sole discretion of the Hosts, without specifying a reason and without notice, in particular if there has been a violation of these Terms of Use and such other policies and terms posted on the Toolkit or if a Registered User has made abusive or unlawful use of the Toolkit.

B     Registered User’s Conduct

  1. The Registered User warrant and agree that, while using the Toolkit, he/she shall not:

    • Infringe by any means materials copyrighted to ITU, infoDev and World Bank ;

    • Upload, post or transmit to or distribute or otherwise publish through the website any material that violates any provision of these Terms of Use;

    • Restrict or inhibit any other User from using and enjoying the website;

    • Constitute or encourage conduct that would constitute a criminal offense or give rise to civil liability;

    • Impersonate, or misrepresent User’s affiliation with any other person or entity;

    • Upload, post, publish, transmit, reproduce, distribute or in any way exploit any information or other material for commercial purposes (other than as expressly permitted by the author of such information or other material);

    • Engage in spamming or flooding; or

    • Attempt to gain unauthorized access to other computer systems through the website.

  2. The Hosts have no obligation to monitor any content on or through the website and assume no obligation. The Registered User acknowledges that the User Contributions section of the Toolkit is neither approved nor endorsed by the Hosts. The Registered User acknowledges and agrees that the Hosts may monitor the website and disclose any information as necessary or appropriate to satisfy any law, regulation or other governmental request, to operate the website properly, or to protect themselves or the Toolkit Users.

  3. The Hosts reserve the right to refuse to post or to remove any information or materials, in whole or in part, that, in their sole discretion, are unacceptable, undesirable, inappropriate or in violation of these Terms of Use, and this at any point for any reason.

  4. The Registered User understands that the Hosts are not responsible for the conduct of any Registered User(s).

C     Code for Users’ contributions

Scope & style

  1. The Registered User agrees to focus on telecommunication and ICT regulatory issues.

  2. The Registered User commits to make contributions on developments of local, national and international importance related to regulatory topics, as identified in the Toolkit section, in which the Registered User contribution appears.

  3. No commercial material of any kind should be posted.

  4. The Registered User is expected to add value to the Toolkit content and provide worthwhile information and perspective. The Toolkit is intended to a very broad and diverse audience around the world – from regulators and policy-makers to academics and other experts.

  5. The Registered User is mindful that contributions will be public for a long time and read by thousands of people around the globe.

  6. The Toolkit is to be assimilated to the official ITU and infoDev websites and is subject to the ITU and World Bank rules and policies. All posts should be written in a neutral and non-judgmental manner.

  7. The Users’ Contributions section is a tool that provides enhanced communication, enabling to report information and distribute it globally. All posts are expected to be clear, concise, focused and not necessary exhaustive.

  8. An average post would be 100-300 words long. Shorter or longer posts are allowed, as it deems appropriate. However, it is not acceptable to have posts longer than one screen (1’000 words). File attachments may be of any length but must be of relevance and utility. The Hosts reserve their right to edit and shorten longer posts, or to delete attachments, without notifying the author.


  1. The Registered User agrees not to post contributions on topics that may be considered objectionable or inflammatory, especially for ITU, ITU Member States, ITU-D Sector Members, the World Bank or World Bank/infoDev donors or the governments they represent.

  2. Any information or material that a Registered User submits or posts to the Toolkit or otherwise makes available on or through the website ("User Contribution(s)”) will be deemed not to be confidential or secret. By submitting or otherwise making a User Contribution available on the Toolkit website, the Registered User:

    • Agree and acknowledge that the User Contribution will not be treated as confidential or proprietary or private.

    • Represent and warrant that the User Contribution:

    • Is original to the Registered User and does not falsify the origin or source of all material contained in a file that is uploaded and that any author contributions, legal notices or proprietary designations or labels in the uploaded file were not deleted;

    • Does not contain material protected by intellectual property laws (or by rights of privacy of publicity) unless the user owns or controls these rights or has obtained the necessary consent;

    • Is public and not private communications;

    • Does not contain any false or misleading indications of origin or statements of fact;

    • Does not contain any content that is unlawful, threatening, harassing, profane, tortuous, defamatory, infringing, indecent, vulgar, obscene, libelous, deceptive, fraudulent, invasive of another's privacy, or hateful; neither does it contain explicit or graphic descriptions or accounts of sexual acts, or include sexual language or language of a violent or threatening nature directed at another individual or group of individuals;

    • Does not defame, abuse, harass, stalk, threaten or otherwise violate the legal rights of others;

    • Does not contain a virus or other harmful component; and

    • Does not contain any commercial elements or advertising of any kind or offer to sell any goods or services, or conduct or forward surveys, contests or chain letters.

    • Grant the Toolkit the royalty-free, unrestricted, worldwide, perpetual, irrevocable, non-exclusive and fully sub-licensable right and license to use, reproduce, modify, edit, adapt, publish, translate, create derivative works from, distribute, perform and display the User Contribution (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed.

  3. The Registered User may not use any of the Toolkit online features to transmit any unsolicited bulk communications (including posts and document files). The Hosts may take any technical remedies to prevent unsolicited bulk communications from entering, utilizing, or remaining within the Toolkit website.

  4. Such materials (as specified above) will be deleted by the Toolkit Administrator and the membership of the registered organization will be suspended without prior notice.

  5. In case of confusion about whether to post something on the Toolkit, the Registered User should always consult with the Hosts prior to posting a document, by sending an email to feedback@ictregulationtoolkit.org.

  6. The User agrees to defend, indemnify and hold the Toolkit, its hosts and content contributors as well as the web service provider harmless from any and all claims, liabilities, costs and expenses, including legal fees, arising in any way from the Registered User’s use of the website or the placement or transmission of the User Contribution on or through the website by the Registered User.

  7. Any content placed in the Users’ Contributions section by a Registered User are the views of the registered User posting the statement, and do not represent the views of the Toolkit, its hosts, ITU Member States, ITU BDT Sector Members or World Bank/infoDev donors or the governments they represent.


  1. No translation of Registered Users contributions will be provided. Information should be posted in English and attachments can be posted in English, French and Spanish. Links to external documents in any language can be included under the full responsibility of the registered User.

Spell check

  1. The interface of this Toolkit does not have an integrated spell-check function. Whenever possible, use a spell-checker of an external application to double-check the text of the contribution before publishing.
