Saudi Arabia -- Regulatory Framework on National Roaming for Mobile Facility Based Providers

This Regulatory Framework (the "Framework") sets out the requirements for national roaming arrangements in Saudi Arabia. Pursuant to this Framework, Dominant Mobile Service Provider must provide national roaming to new licensed mobile Facilities Based Providers (FBP). The terms for the national roaming arrangements are to be commercially negotiated, with the requirement that the negotiations be concluded within 60 days from the new Mobile FBP's request. Other Mobile FBPs may provide national or roaming services to any other new Mobile FBP on the basis of a commercial agreement mutually negotiated. All parties to national roaming agreements must be filed with the Saudi Regulator, the Communications and Information Technology Commission (CITC). National roaming services may be provided for not more than five years from the launch of the hosted Mobile FBP's network unless the parties agree to an extension and provided that the parties obtain CITC's prior written approval. The Framework outlines a number of other requirements for mobile roaming arrangements, including a general provision stipulating that national roaming shall not lead to anti-competitive consequences.
