Lebanon -- Significant Market Power Regulation

This Regulation's main purpose is to provide guidance to providers on the approach the Telecommunications Regulatory Authority of Lebanon (the TRA) will take in analyzing the telecommunications market to assess if providers have Significant Market Power (SMP) and in making decisions accordingly. The Regulation describes processes designed to ensure that all providers and applicants for service provider status are treated fairly and in a non-discriminatory manner. It also aims to encourage best practices by service providers and to promote the provision of high quality services to end-users, through technical and economic efficiency. The TRA’s activities concerning SMP under the Regulation include the following: (i) defining relevant markets in terms of products and services, customer groups, and geography; (ii) carrying out market analyses of each of the relevant markets to determine whether any providers have SMP in those relevant markets; (iii) issuing decisions relating to providers having SMP in a relevant market; and (iv) imposing regulatory obligations on those providers designated as having SMP. The Regulation contains provisions relating to market definition procedure, determination of SMP, regulations to be applied to service providers with SMP, and dispute resolution procedures.
